Det har varit frustrerande att se hur r\u00e4ttsliga brister i artikeln och avsaknaden av tydligt definierade roller och ansvarsomr\u00e5den mellan EU-kommissionen och medlemsstaterna har lett till att genomf\u00f6randet av artikel 17 har skjutits \u00e5t sidan. Artikel 17 \u00e4r nyckeln till att s\u00e4kerst\u00e4lla en r\u00e4ttvis f\u00f6rdelning av fiskem\u00f6jligheter \u2013 tillg\u00e5ng till b\u00e5de fiskevatten och fiskekvoter \u2013 f\u00f6r sm\u00e5skaligt fiske. \u00a0Den senaste STECF-rapporten om sociala data inom fisket (STECF 23-17), som publicerades i slutet av 2023, analyserar svaren fr\u00e5n 22 medlemsstater (dvs. alla EU:s kuststater) p\u00e5 ett fr\u00e5geformul\u00e4r om genomf\u00f6randet av artikel 17. STECF konstaterar att \u201cde befintliga ramarna f\u00f6r fiskerif\u00f6rvaltningarna i medlemsstaterna och deras system f\u00f6r f\u00f6rdelning av fiskem\u00f6jligheter har visat sig utg\u00f6ra ett hinder f\u00f6r genomf\u00f6randet av artikel 17 p\u00e5 grund av institutionell tr\u00f6ghet\u201d. STECF konstaterar ocks\u00e5 att \u201cfiskem\u00f6jligheterna inte \u00e4r tydligt definierade i EU:s r\u00e4ttsakter\u201d.<\/p>\n<p>Institutionell tr\u00f6ghet, bristande r\u00e4ttslig tydlighet, avsaknad av tydligt definierade roller och ansvarsomr\u00e5den samt brist p\u00e5 tydligt definierade kriterier utg\u00f6r stora hinder f\u00f6r att uppn\u00e5 ett socialt r\u00e4ttvist, milj\u00f6m\u00e4ssigt h\u00e5llbart och ekonomiskt b\u00e4rkraftigt fiske. Man skulle kunna s\u00e4ga att artikel 17, i sin nuvarande form, \u00e4r d\u00f6md att misslyckas. Utmaningen med artikel 17 best\u00e5r d\u00e4rf\u00f6r i att utforma l\u00e4mpliga kriterier av milj\u00f6m\u00e4ssig, social och ekonomisk karakt\u00e4r, med tydliga riktlinjer f\u00f6r hur de ska till\u00e4mpas samt tydligt f\u00f6rdelade roller och ansvarsomr\u00e5den mellan kommissionen och medlemsstaterna. Insamlingen av sociala data har varit ett lagkrav sedan 2018, och STECF presenterade en prelimin\u00e4r analys av artikel 17 i sin rapport fr\u00e5n 2020 (STECF 20-14), som gav viss bakgrundsinformation om utvecklingen av artikel 17 och inf\u00f6randet av sociala kriterier.
