Sinds de oprichting heeft LIFE voortdurend gelobbyd voor de tenuitvoerlegging van artikel 17 als de manier om tot een eerlijke visserij en een duurzaam milieu te komen. Het was frustrerend om te zien hoe de uitvoering van artikel 17 op de lange baan werd geschoven door juridische tekortkomingen in het artikel en een gebrek aan duidelijk afgebakende taken en verantwoordelijkheden tussen de EG en de lidstaten. Artikel 17 vormt de sleutel tot een eerlijke toewijzing van vangstmogelijkheden - toegang tot zowel visgronden als visquota - voor SSF. In het meest recente WTECV-verslag over sociale gegevens in de visserij (WTECV 23-17), dat eind 2023 wordt gepubliceerd, worden de antwoorden van 22 lidstaten (d.w.z. alle kuststaten van de EU) op een vragenlijst over de tenuitvoerlegging van artikel 17 geanalyseerd. Het verslag is nuttig omdat het een historisch overzicht geeft van de manier waarop de vangstmogelijkheden in de EU zijn toegewezen en waarom het zo'n probleem is geweest om ervoor te zorgen dat de toewijzingssystemen van de lidstaten criteria gebruiken die zowel transparant als objectief zijn. Het WTECV merkt op dat \"het reeds bestaande kader van visserijadministraties in de lidstaten en hun systemen voor de verdeling van vangstmogelijkheden een obstakel zijn gebleken voor de uitvoering van artikel 17, vanwege institutionele inertie. 17, als gevolg van institutionele inertie\". Het WTECV merkt ook op dat \"de vangstmogelijkheden niet duidelijk zijn gedefinieerd in de wetsteksten van de EU\".<\/p>\n

Institutionele inertie, een gebrek aan juridische duidelijkheid, een gebrek aan duidelijk gedefinieerde rollen en verantwoordelijkheden, en een gebrek aan duidelijk gedefinieerde criteria vormen belangrijke belemmeringen voor het bereiken van een sociaal rechtvaardige, ecologisch duurzame en economisch levensvatbare visserij. Je zou kunnen zeggen dat artikel 17 in zijn huidige vorm ontworpen is om te mislukken. De uitdaging met artikel 17 is dan ook om passende criteria op te stellen van ecologische, sociale en economische aard, met duidelijke richtsnoeren voor de toepassing ervan en duidelijke taken en verantwoordelijkheden voor de EG en de lidstaten. Het verzamelen van sociale gegevens is sinds 2018 wettelijk verplicht en het WTECV heeft in zijn verslag over 2020 (WTECV 20-14) een eerste analyse van artikel 17 gemaakt, waarin enige achtergrond wordt gegeven bij de ontwikkeling van artikel 17 en de opname van sociale criteria. LIFE herinnert aan het in 2021 gepubliceerde verslag \"How EU fishing can become Low Environmental Impact, Low Carbon and Socially Just\" (Hoe de EU-visserij milieuvriendelijk, koolstofarm en sociaal rechtvaardig kan worden), waarin al potenti\u00eble milieu-, sociale en economische criteria worden aangewezen.<\/p>\n
