LIFE kom sammen med mange andre organisationer med bem\u00e6rkninger og delte deres holdning til det forslag, som Kommissionen har fremsat. Dokumentet og alle svar, hvoraf de fleste er uenige i Kommissionens forslag, kan findes <\/span><a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/14057-Fisheries-correction-to-multiannual-plans_en\"><span style=\"font-weight: 400;\">her<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kommissionen forklarer i sit forslag, at artikel 4, stk. 6, i MAP\u2019en for \u00d8sters\u00f8en kan f\u00f8re til situationer, hvor bestemmelsen er i strid med andre regler i MAP\u2019erne vedr\u00f8rende fasts\u00e6ttelsen af fiskerimuligheder, hvilket kan have potentielt alvorlige socio\u00f8konomiske konsekvenser. P\u00e5 den ene side kan 5%-reglen betyde, at fiskerimulighederne ikke kan fasts\u00e6ttes, og at det p\u00e5g\u00e6ldende fiskeri m\u00e5 indstilles. P\u00e5 den anden side kr\u00e6ver beskyttelsesbestemmelserne i MAP&#x27;erne, at der vedtages afhj\u00e6lpende foranstaltninger for at bringe bestanden op over B<\/span><span style=\"font-weight: 400;\">udl\u00f8se<\/span><span style=\"font-weight: 400;\">, baseret p\u00e5 en konkret vurdering af hensigtsm\u00e6ssigheden af at v\u00e6lge en s\u00e5dan foranstaltning i overensstemmelse hermed med de kriterier, der er fastsat i MAP'erne. Desuden henviser MAP'erne til muligheden og ikke forpligtelsen til at suspendere det m\u00e5lrettede fiskeri.\u00a0 <\/span><b>Derfor foresl\u00e5r Kommissionen at<\/b> <b>slet MAP-artikel 4.6<\/b><span style=\"font-weight: 400;\"> (<\/span><i><span style=\"font-weight: 400;\">Fangstmulighederne skal under alle omst\u00e6ndigheder fasts\u00e6ttes p\u00e5 en s\u00e5dan m\u00e5de, at der er mindre end en 5 % sandsynlighed for, at gydebestandsbiomassen falder til under Blim<\/span><\/i><span style=\"font-weight: 400;\">). Kommissionens forslag angiver ogs\u00e5, at Kommissionen i 2023 <\/span><i><span style=\"font-weight: 400;\">dr\u00f8ftet<\/span><\/i><span style=\"font-weight: 400;\"> 5%-reglen med de ber\u00f8rte parter, is\u00e6r \u00d8sters\u00f8ens R\u00e5dgivende R\u00e5d og BALTFISH: \u201c<\/span><i><span style=\"font-weight: 400;\">St\u00f8rstedelen af interessenterne gav udtryk for dyb bekymring over, hvorvidt 5%-reglen er i overensstemmelse med de \u00f8vrige regler i de f\u00e6lles fiskeribestemmelser (MAP), der regulerer fasts\u00e6ttelsen af fiskerimuligheder, samt over de potentielt alvorlige socio\u00f8konomiske konsekvenser heraf<\/span><\/i><span style=\"font-weight: 400;\">\u201d.<\/span><\/p>\n<p><b>LIFE's svar kan ses nedenfor:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u201cKommissionens forslag er skuffende. Sp\u00f8rgsm\u00e5let om, hvad der skal g\u00f8res, n\u00e5r bestandene ligger under MSY B-trigger og B-lim, er uafklaret, og det foresl\u00e5ede \u00e6ndringsforslag efterlader os i en v\u00e6rre situation end f\u00f8r. Forslaget undergraver fiskerisektorens socio\u00f8konomiske levedygtighed, is\u00e6r for den sm\u00e5skalafiskerfl\u00e5de, ved at fjerne en central mekanisme til genopretning af fiskebestandene. Der er helt klart problemer med 95%-reglen, hvilket fremg\u00e5r tydeligt i ikke-selektive blandede fiskerier. Hvis fiskerierne er selektive og ikke kr\u00e6ver bifangstkvoter, er det ikke s\u00e5 stort et problem. Det er afg\u00f8rende for fiskerivirksomhedernes levedygtighed og b\u00e6redygtighed at sikre, at fiskebestandene ligger over Blim, og artikel 4.6 har derfor positive fordele. Et centralt sp\u00f8rgsm\u00e5l er de videnskabelige beregninger, som Blim, Fmsy og de tilknyttede referencepunkter bygger p\u00e5. Vi noterer med bekymring og skuffelse, at ICES ikke anvender BMSY som udgangspunkt for at vurdere, hvilket niveau for fisked\u00f8delighed der svarer til MSY. Dette er et centralt problem og en af grundene til, at s\u00e5 mange bestande i \u00d8sters\u00f8en er faldet under referencev\u00e6rdierne. Det afg\u00f8rende er at sikre, at bestandsbiomassen ligger p\u00e5 sunde niveauer (over BMSY). MAP har ikke form\u00e5et at opn\u00e5 dette, men \u00e6ndringsforslaget vil sandsynligvis forv\u00e6rre situationen. Det bidrager bestemt ikke til at sikre, at de socio\u00f8konomiske muligheder for fiskeriet forbedres.
