Det har v\u00e6ret frustrerende at se, hvordan juridiske svagheder i artiklen og manglen p\u00e5 klart definerede roller og ansvarsomr\u00e5der mellem EU-Kommissionen og medlemsstaterne har bevirket, at implementeringen af artikel 17 er blevet sat til side. Artikel 17 udg\u00f8r n\u00f8glen til at sikre en retf\u00e6rdig tildeling af fiskerimuligheder \u2013 adgang til s\u00e5vel fiskepladser som fiskekvoter \u2013 for det kystn\u00e6re sm\u00e5skalafiskeri (SSF). Den seneste STECF-rapport om sociale data i fiskeriet (STECF 23-17), der blev offentliggjort i slutningen af 2023, analyserer svar fra 22 medlemsstater (dvs. alle kystn\u00e6re EU-stater) p\u00e5 et sp\u00f8rgeskema om implementeringen af artikel 17. Rapporten er nyttig, fordi den giver et historisk overblik over, hvordan fiskerimuligheder er blevet tildelt i EU, og hvorfor det har v\u00e6ret s\u00e5 vanskeligt at sikre, at medlemsstaternes tildelingssystemer anvender kriterier, der er b\u00e5de gennemsigtige og objektive. STECF bem\u00e6rker desuden, at \u201cfiskerimuligheder ikke er klart definerede i EU's retlige tekster\u201d.<\/p>\n<p>Institutionel tr\u00e6ghed, manglende retlig klarhed, manglende klart definerede roller og ansvarsomr\u00e5der samt manglende klart definerede kriterier udg\u00f8r v\u00e6sentlige hindringer for at opn\u00e5 et socialt retf\u00e6rdigt, milj\u00f8m\u00e6ssigt b\u00e6redygtigt og \u00f8konomisk levedygtigt fiskeri. Det kan siges, at artikel 17 i sin nuv\u00e6rende form er skabt til at mislykkes. Udfordringen med artikel 17 er derfor at udforme passende kriterier af milj\u00f8m\u00e6ssig, social og \u00f8konomisk karakter med klare retningslinjer for, hvordan de skal anvendes, samt klare roller og ansvarsomr\u00e5der tildelt EU-Kommissionen og medlemsstaterne. Indsamlingen af sociale data har v\u00e6ret et juridisk krav siden 2018, og STECF (Videnskabelige, Tekniske og \u00d8konomiske Komit\u00e9 for Fiskeri) leverede en forel\u00f8big analyse af artikel 17 i deres rapport fra 2020 (STECF 20-14), som gav en vis baggrund for udviklingen af artikel 17 og medtagelsen af sociale kriterier.
